On Monday, April 7, Judge Matthew Kacsmaryk in the US District Court for Northern Texas ruled to overturn key elements of a Biden administration rule that established the first-ever minimum staffing ratios for nursing facilities. The court\u2019s opinion stated that the regulations ultimately overstepped CMS\u2019 authority, noting \u201cthe agency lacks authority to eliminate consideration of a facility\u2019s nursing \u2018needs\u2019 when prescribing minimum staffing standards\u201d, and \u201cany regulatory response must be consistent with Congress\u2019s legislation governing nursing homes.\u201d Continue reading here…<\/a><\/p>\n\n\n\n
