The HHS’ rule 0936-AA08 is delayed for almost two years
The U.S. District Court for the District of Columbia has issued a court order delaying the Department of Health and Human Services’ rule 0936-AA08 for almost two years. The prior administration rule would have altered payments from drugmakers to pharmacy middlemen –pharmacy benefit managers (PBMs) such that they can’t fluctuate based on the price of a drug. However, the drug companies say the current system forces them to keep prices high because PBMs who help decide how a drug will be covered by insurance demand high discounts to give products preferential treatment.
