It’s looking more and more like the courts will be required to settle the gradually expanding fight between insurers and civil rights activists on the issue of coverage for transgender transitioning and related issues. Private employers operating their own health insurance plans are at the center of the argument seeking protection from what they consider to be the Affordable Care Act’s regulatory “overreach,” and it looks like there will be some movement toward resolution as the Obama administration’s final year winds down.
